Terms of use.

These terms bind NYTHY (“we”) and you, for use of the Leum app (iPhone, iPad, Apple Watch, widgets) and the leum.app website.

These terms are written in French; in case of translation, the French version prevails. They go with the privacy policy, the Actions policy, the subscription policy, the refund policy and the account deletion policy: each prevails on its subject.

• Leum — the app and its companions (widgets, Apple Watch, Siri shortcuts).
• Spaces — Nutrition, Sleep, Finance, Projects.
• Assistant or Leum Agent — the part of the app that answers you and can act at your request.
• Action — the unit that measures your use of the assistant. It is not money: see the Actions policy.
• Plans — Free and Premium (monthly, 3 months or 6 months).
• Logs — everything you enter, import or allow in the app.

Leum is a tool for wellbeing and personal organisation: you enter, you track, you plan. The finances are the ones you enter: Leum connects to no bank and makes no payment.

Leum is not a medical device (Regulation (EU) 2017/745) and does not help make a diagnosis. Leum is not a financial, tax or legal adviser.

The Sleep questionnaires (ISI, ESS, STOP-BANG) and the estimates (snoring, regularity, scores) are personal tracking reference points. They do not replace a health professional.

Nutrition advice and calorie goals are general. If you are pregnant, breastfeeding, a minor, under treatment, or affected by an eating disorder or a chronic illness, see a professional before following a suggestion. Leum blocks automatic goals under 18, but does not check age.

Leum is provided as is, with the limits described here and in the assistant usage policy. The app works on your device; the assistant, the sounds, the iCloud copy and purchases need a connection.

We may evolve Leum: add, remove or fix features, change model or provider. We do not significantly degrade the essential features of a subscription during a period already paid for. If a change clearly reduces what Premium brings you, you can cancel free of charge and ask for a refund of the remaining period.

We may interrupt the assistant, for a moment (maintenance, outage) or for good (a provider shutting down, legal obligation, end of business). In the second case, you are told at least 60 days ahead in the app; no renewal takes place after the shutdown, and you can ask for a refund of the remaining period. The rest of the app and your logs stay accessible.

Leum needs iOS and Apple services (iCloud, purchases, Health, weather, music). They belong to Apple and follow its own terms.

You may use Leum for yourself, on your devices. This right is personal: you can neither assign it nor resell it.

You may not: copy, distribute or resell Leum; modify it or try to extract its code, models, internal instructions or keys; build a competing app from it; use robots, scripts or multiple accounts to exceed the assistant’s limits; remove notices and warnings; use it to process other people’s data.

If you do not respect these rules or those of “Using the assistant well”, we may suspend your access to the assistant, without refunding the current period, within the limits of “Your guarantees and our liability”.

Leum belongs to NYTHY: the brand, the interface, the images, the sounds, the texts and the code. These terms give you nothing more than the right to use the app.

Your logs belong to you. We use them neither for advertising, nor for resale, nor to train models — only for the features you ask for (privacy policy).

The catalogues Leum consults (Open Food Facts, nutrition databases, music) remain their authors’. Apple, iPhone, iPad, Apple Watch, App Store, iCloud and Siri are trademarks of Apple Inc. Leum is neither approved by Apple nor linked to Apple.

Leum creates no account with us: no sign-up, no password. Your device is recognised by a number drawn at random.

You are responsible for the security of your devices and your iCloud. We cannot recover a deleted log, restore an account, or read your iCloud.

The iCloud copy is always on. By using Leum, you accept that your logs are copied to your iCloud, under your Apple account.

Leum is designed for one person only. If you use it to track someone else, getting their consent is on you.

Free gives access to the four Spaces and a limited use of the assistant. Premium is a subscription that renews by itself until you cancel it, sold on the App Store: €14.99 a month, €44.99 for 3 months or €89.99 for 6 months, VAT included. The price that counts is the one Apple shows at the moment of purchase, in your country and currency. A 7-day free trial may be offered to you once, with a volume of Actions halved.

Billing, renewal, cancellation and refunds are detailed in the subscription policy and the refund policy, which prevail over this part.

Family Sharing is not available for Premium.

Prices may change, never for a period already paid. Apple is your seller: Apple collects, invoices, collects the VAT and handles refund requests.

Use of the assistant is counted in Actions: 15 a month on Free, 1,000 on monthly Premium (1,500 on 3 months, 2,000 on 6 months), 500 during the 7-day trial. The counter starts fresh each new period (the 1st of the month on Free, your subscription date on Premium), with no carry-over of what is left.

The cost of a request follows what it actually asks of the assistant: less than an Action for a simple question, 3 to 4 with a web search, and more for a multi-step request (8 at most). The full scale is in the Actions policy.

Actions are not money: they cannot be resold, transferred or refunded, except in the cases of the refund policy. They are not bought separately: they come from your Plan.

No Action is counted when an answer fails, is interrupted or is refused.

You are responsible for what you ask and for what you do with the answers. The assistant can be wrong, invent a detail or suggest an unsuitable action. Check before acting, especially for an amount, a medicine, an allergy, a deadline or a health decision.

Do not entrust it with another person’s conversations, documents or personal data without their consent.

It is forbidden to use it for: illegal, hateful or harassing content, sexual content involving minors, or content pushing to violence; instructions to harm yourself or someone; passing yourself off as a professional (diagnosis, legal or tax document); collecting other people’s data; impersonating someone; bypassing the limits or the security of the service.

The assistant is not an emergency service. In case of danger, call 15, 17, 18 or 112; in case of distress, 3114 (suicide prevention, France). Leum displays these numbers when it detects distress, but this detection is automatic and can be wrong. It warns nobody, and we do not read your conversations.

The assistant is artificial intelligence: its answers are produced by a model, not verified. Its limits and what it sees of your data are in the assistant usage policy.

You can stop whenever you want: delete your account in the app (Settings > Delete account), it is immediate and final. You can cancel your subscription at any time in your App Store account; it stops at the end of the current period.

We may suspend your access to the assistant in case of serious non-compliance with parts 5 or 10, automated use, fraud, non-payment reported by Apple, or for a legal or security reason. The measure is proportionate, explained in writing when it targets you personally, and you can contest it at [email protected] (answer within 15 days). It gives no right to a refund of the current period, unless it was clearly unjustified. It never touches your logs or the rest of the app.

After account deletion or the end of the service, what must keep applying keeps applying: ownership of your data, liability, applicable law.

Leum is provided as is: we do not promise it will be error-free, always available, or compatible with all hardware.

Your consumer rights remain intact: the legal guarantees of conformity and hidden defects (art. L. 217-3 et seq. of the French consumer code, art. 1641 et seq. of the French civil code), and our liability in case of wilful deception, gross or deliberate fault, or bodily harm. Nothing here deprives you of a remedy.

Assistant errors. We answer for the technical working order of the service, not for the accuracy of an answer produced at your request. We remain liable if an essential feature announced at sale is absent or misleading.

Our liability for direct damage is limited to what you paid over the last twelve months (€100 on Free). We do not answer for indirect or unforeseeable damage, except deception, gross fault or breach of an essential obligation.

Data loss. We control neither your device nor your iCloud. Export your logs when they matter to you. A loss due to your device failing, to deleting your account or to an iCloud failure is not of our making. These limits do not apply where the law forbids them.

We may modify these terms, to follow the product, the law or our providers.

If you have an ongoing subscription, any important change is announced to you at least two months ahead, in the app and by email if we have yours. You can then cancel free of charge before it applies. Without cancellation in that window, the change is accepted.

A correction with no effect on your rights (a clarification, contact details) may be published without notice, with the date and version number updated. Old versions are available on request.

We are not liable for a delay or an outage caused by force majeure (art. 1218 of the French civil code): Apple, Cloudflare, a model provider or a carrier failing, a decision by an authority, a strike, a natural disaster, a conflict. If Premium becomes unusable for more than 30 days in a row for this reason, you can ask for a refund of the remaining period.

These terms are governed by French law, without removing the mandatory protections of the country where you live.

No court is imposed on you: you can bring the matter to the court of your home. For a business, it is the commercial court of Strasbourg.

In case of disagreement, write first to [email protected]: answer within 15 days. Otherwise, you can refer to the CNIL for your personal data, and the DGCCRF for a consumer dispute. No consumer mediator is designated yet; it will be indicated here as soon as it is.

• If a clause is void, the others keep applying.
• Not enforcing a clause once does not mean waiving it.
• We may transfer this contract in a merger or a sale of business, telling you if you are a subscriber. You cannot transfer yours without our written agreement.
• Apple benefits from these terms for what concerns the App Store purchase, but provides neither maintenance nor support for Leum: NYTHY does.
• These terms and the pages linked to them form the whole agreement between us.
